Department of Insurance
Texas operates under a File & Use rate system for property and casualty insurance, allowing insurers to implement rates upon filing without prior approval unless subject to specific prior approval requirements. The Texas Department of Insurance (TDI) actively regulates insurance through comprehensive statutes and maintains robust consumer protection standards. Texas is unique as one of few states where workers' compensation coverage is optional for most private employers.

Mandatory Written Explanations for Policy Declinations, Cancellations, and Nonrenewals
Requires insurance companies to automatically provide written statements explaining why auto or home insurance policies were declined, canceled, or nonrenewed. Creates quarterly reporting requirements for insurers to TDI.
Affects all Texas homeowners and auto insurance policyholders and applicants who will now automatically receive written explanations of adverse underwriting decisions.

Prohibition of Marital Status Discrimination After Spouse's Death
Prohibits insurers from discriminating based on an insured's marital status following the death of the insured's spouse, closing the "widow penalty" loophole where widows and widowers were charged higher rates.
Protects widows and widowers from discriminatory rate increases on home and auto insurance policies after spouse's death.
Effective: 2025-09-01
Anti-Tying Provision for Property and Auto Insurance
Prohibits insurers from requiring policyholders to bundle residential property insurance and personal auto insurance from the same insurer or affiliated insurer as a condition of coverage.
Gives Texas consumers freedom to purchase home and auto insurance from different companies without penalties or coverage denials.

Mandatory Appraisal Provisions in Auto and Residential Property Policies
Requires personal auto and residential property policies to include an appraisal provision to resolve disputes about the amount of loss, providing an alternative dispute resolution mechanism.
Provides Texas policyholders with a mandatory mechanism to resolve claim amount disputes without litigation.

Medicare Supplement Access for Under-65 Individuals (Chris Larkin ALS Act)
Requires Medicare supplement issuers to offer specific coverage and pricing for people under 65 with amyotrophic lateral sclerosis (ALS) or end stage renal disease, expanding Medigap eligibility.
Expands Medicare supplement plan access to Texans under 65 with ALS or ESRD who previously faced coverage barriers.
