Department of Insurance
Oklahoma operates under a modified prior approval system where competitive markets use a 'use and file' approach (rates filed within 30 days after use), while noncompetitive markets require prior approval (rates filed at least 30 days before use). The Oklahoma Insurance Department, led by Commissioner Glen Mulready since 2019, actively regulates all insurance lines and is transitioning to operate a state-based health insurance exchange beginning in 2026.
Auto Insurance
Notable Laws
- Uninsured Motorist Coverage Mandatory Offer (36 O.S. § 3636): Oklahoma requires all auto insurers to offer uninsured/underinsured motorist coverage with every policy. Coverage can be rejected in writing, but the rejection remains valid for the life of the policy. No stacking of UM/UIM limits unless expressly provided by carrier (for policies issued after November 1, 2014).
- UM Substitution Right (36 O.S. § 3636(E)): If insured reaches tentative settlement with tort-feasor for liability limits, written notice must be given to UM carrier by certified mail. UM carrier has 60 days to substitute its payment for the tentative settlement amount.
- Transportation Network Company (TNC) Insurance Requirements (47 O.S. § 1025): TNC drivers must carry $50,000/$100,000/$25,000 while logged on but not engaged in ride, and $1,000,000 combined coverage while engaged in prearranged ride. Proof of coverage may be presented electronically.
- SR-22 Financial Responsibility Certification (47 O.S. § 7-324; 47 O.S. § 7-600): Oklahoma requires SR-22 certificates for high-risk drivers to prove financial responsibility. Form must be approved by Insurance Commissioner and verify existence of security meeting minimum liability limits.
- Compulsory Insurance Verification (47 O.S. § 7-600 et seq.): All motor vehicles must maintain continuous liability insurance meeting state minimums. Security may be satisfied by authorized insurer policy, cash/securities deposit, or approved self-insurance having equivalency of minimum vehicle liability limits.
- 36 O.S. § 3636 - Uninsured/Underinsured Motorist Coverage: Insurers must offer UM/UIM coverage equal to bodily injury limits; named insured may reject in writing using approved form
- 47 O.S. § 7-600 - Financial Responsibility Law: Requires proof of minimum liability coverage or other security for all vehicles operated in Oklahoma
- 36 O.S. § 1250.5 - Unfair Claims Settlement Practices Act: Prohibits insurers from engaging in various unfair claims practices including roof claim limitations and refund timeframes (amended by HB 3495, 2022)
- 47 O.S. § 7-606 - Penalties for Driving Uninsured: First offense fine up to $250, possible jail time up to 30 days, and license suspension
- 36 O.S. § 3639.1 - Personal Residential Insurance Cancellation: Insurers must provide specific notice periods and cannot cancel based on first claim filing in certain circumstances
Homeowners Insurance
Notable Laws
- Lender-Placed Insurance Limits (36 O.S. § 3639.3): Lenders cannot require homeowner coverage exceeding replacement value of dwelling and contents. Replacement value excludes land value and cleanup costs. Effective November 1, 2004.
- FORTIFIED Roof Discounts Mandatory (36 O.S. § 961-962; HB 3089 (2024 - Strengthen Oklahoma Homes Act)): Admitted insurers must provide premium discounts for FORTIFIED-certified homes. State offers grants up to $10,000 for FORTIFIED roof retrofitting. Program launched in 2024 to reduce wind/hail damage and lower insurance costs.
- Roof Claim Filing Window for Wind/Hail (36 O.S. § 1250.5(7); HB 3495 (2022)): Consumers have at least 24 months to file roof claims for wind or hail loss not visible without inspection. Claims must be allowed after first anniversary but no later than 24 months after date of loss if damage not evident without inspection.
- Claim Refund Time Limits (36 O.S. § 1250.5(15); HB 3495 (2022)): Insurers requesting refund of claim payments must do so within 6 months from claimant or 12 months from health care provider. Does not apply to fraud or agreed refunds. Effective May 16, 2022.
- Earthquake Coverage Special Provisions (Oklahoma Insurance Department Guidelines): Earthquake insurance must be obtained as endorsement or standalone policy (not included in standard homeowners). Deductibles must be percentage of insured value (typically $50-$300 annually). May include waiting periods of 72 hours to 60 days post-earthquake.
- 36 O.S. § 3639 - Cancellation Requirements: Insurers must provide at least 10 days notice for cancellation, 30 days for nonrenewal (OAC 365:15-1-14)
- 36 O.S. § 3639.1 - Personal Residential Insurance Protections: Limits cancellation/nonrenewal after first claim; prohibits premium increase based solely on inquiry
- HB 1084 (2025) - Assignment of Benefits Prohibition: Prohibits solicitation/acceptance of post-loss benefit assignments for property damage under residential policies (effective November 1, 2025)
- 36 O.S. § 1250.5 - Roof Claims: Consumers have at least 24 months to file roof claim for wind/hail loss not visible without inspection (HB 3495, 2022)
