Department of Insurance

New Mexicans purchasing health insurance through BeWellNM marketplace receive continued state subsidies to offset premium increases from loss of federal tax credits.

Additional Unfair Insurance Claims Practice
Amends NMSA § 59A-16-20 to prohibit property or homeowner's insurers from treating an applicant's or insured's inquiry relating to damage or loss as a claim when the facts of the inquiry are not covered by the policy.
Policyholders can inquire about potential claims without risk of increased premiums or coverage denial; insurers prohibited from penalizing inquiries that don't result in covered claims.

Add Classes to Prior Authorization Drugs
Amends Prior Authorization Act (NMSA §§ 59A-22B-2, 59A-22B-5, 59A-22B-8) to prohibit prior authorization and step therapy requirements for FDA-approved prescription drugs treating specific conditions including HIV/AIDS, mental health disorders, cancer, and other serious conditions.
Patients with serious conditions gain immediate access to FDA-approved medications without prior authorization delays; insurers must remove barriers to critical medications.

State Employee Health Care Costs Reduction
Increases state contribution to employee health insurance premiums to at least 80% of cost, significantly reducing out-of-pocket premiums for state employees.
State employees see lower health insurance premiums and increased take-home pay due to higher employer contribution to health coverage.
