Overview

Louisiana transitioned to a "File and Use" rate filing system in 2024 (Act 10/SB 295), replacing its prior approval system. The state is an at-fault tort state for auto insurance but implemented modified comparative fault effective January 1, 2026, barring recovery if plaintiff is 51% or more at fault. The Louisiana Department of Insurance is led by elected Commissioner Tim Temple and regulates all insurance lines under Title 22 of the Louisiana Revised Statutes.
