Department of Insurance
Louisiana transitioned to a "File and Use" rate filing system in 2024 (Act 10/SB 295), replacing its prior approval system. The state is an at-fault tort state for auto insurance but implemented modified comparative fault effective January 1, 2026, barring recovery if plaintiff is 51% or more at fault. The Louisiana Department of Insurance is led by elected Commissioner Tim Temple and regulates all insurance lines under Title 22 of the Louisiana Revised Statutes.

Modified Comparative Fault
Replaces Louisiana's pure comparative fault system with modified comparative fault - bars recovery if plaintiff is 51% or more at fault; otherwise reduces damages proportionally to fault percentage.
Plaintiffs found to be 51% or more at fault for an accident can no longer recover any damages, significantly changing personal injury litigation.
Effective: 2026-01-01
No Pay, No Play Enhancement
Raises the recovery threshold for uninsured drivers to $100,000 for both bodily injury and property damage - uninsured drivers cannot recover the first $100,000 in damages regardless of fault.
Uninsured drivers face significantly higher financial barriers to recovery, incentivizing insurance compliance and potentially reducing premiums for insured drivers.
Effective: 2025-08-01
First Lapse Protection
Prohibits insurers from raising rates or adding surcharges for a driver's first lapse in coverage not exceeding 90 days, and ensures they cannot deny coverage solely due to a lapse.
Drivers experiencing their first coverage lapse are protected from rate increases and coverage denials, improving accessibility for those with temporary financial hardships.
Effective: 2026-01-01
Prescriptive Period Extension
Increases the prescriptive period (statute of limitations) for wrongful death and survival actions from 1 year to 2 years.
Families of deceased accident victims have an additional year to file wrongful death lawsuits, providing more time to prepare claims.
Effective: 2025-08-01
Rate Filing Deregulation - File and Use
Replaces Louisiana's prior approval system with a "file and use" rating system where rate filings are deemed approved when filed, though the Commissioner retains a 30-day window to disapprove.
Insurers can implement rate changes immediately upon filing, expediting market responses but potentially leading to faster premium increases.
Effective: 2024-05-07
